Whistleblower Policy

Kultur Mercado encourages its employees to report improper activities in the workplace and will protect employees from retaliation for making any such report in good faith.

Employee Rights
Employees have the right to report, without suffering retaliation, any activity by Kultur Mercado or any of its employees that the employee reasonably believes: 1) violates any state or federal law; 2) violates or amounts to noncompliance with a state or federal rule or regulation, or 3) violates fiduciary responsibilities by a nonprofit corporation. In addition, employees can refuse to participate in an activity that would result in a violation of state or federal statutes, or a violation or noncompliance with a state or federal rule or regulation. Employees are also protected from retaliation for having exercised any of these rights in any former employment.

The whistleblower protection laws do not entitle employees to violate a confidential privilege of Kultur Mercado (such as the attorney-client privilege).

Where to Report
Employees have the duty to comply with all applicable laws and to assist Kultur Mercado in ensuring legal compliance. An employee who suspects a problem with legal compliance is required to report the situation(s) to the President/Executive Director or Chair of the Board of Directors if the complaint involves the President.

Employees may also report information regarding possible unlawful activity to an appropriate government or law enforcement agency.

Non-Discrimination Policy

Kultur Mercado does not and shall not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status, in any of its activities or operations. These activities include, but are not limited to, the appointment to and termination from its Board of Directors, hiring and firing of staff or contractors, selection of volunteers, selection of vendors, and providing of services.

Donor Policy

Responsibility to Donors
Kultur Mercado is committed to a relationship with its donors based on the highest ethical standards. This involves treating all transactions with donors in strict confidence. Kultur Mercado has adopted the Donor Bill of Rights of the Association of Fundraising Professionals as official policy.

Privacy Commitment to Donors

Kultur Mercado will not sell, share or trade our donors’ names or personal information with any other entity, nor send mailings to our donors on behalf of other organizations.

This policy applies to all information received by the Kultur Mercado, both online and offline, on any web-based platform as well as any electronic, written, or oral communications.

To the extent any donations are processed through a third-party service provider, the donors’ information will only be used for purposes necessary to process the donation.

Kultur Mercado considers stewardship of our supporters and their privacy a top priority. This Privacy Policy was created to give you confidence regarding our responsible stewardship of your information. In addition to this Privacy Policy, we are ensuring all data that is submitted on our website is secure and adheres to PCI compliance standards, to the best of our knowledge and ability.

Kultur Mercado values the privacy of our members, customers, and visitors. We collect information only to help us better serve our members and the nonprofit sector. It is our policy to collect and store only personal information that is knowingly provided to us and publicly available. We do not share personal information. Kultur Mercado also collects organizational information for research and member services.

This Privacy Policy explains our practices regarding the collection of information from this website that can personally identify you and/or your organization, and the choices you can make about the way your information is collected and used.

Organizational Information Collected
Kultur Mercado makes organizational contact information available through our online Staff Directory. We may occasionally make mailing lists of nonprofit organizations available to third parties. These lists are limited to organization names and postal addresses.

Any organization may request its information be omitted from lists provided to third parties by contacting us and expressing its preference not to have its information shared.

Browser Information Collected on the Site and Advertising

The website collects statistical information through a log file. This generates a monthly report that indicates which pages were visited and how frequently, referring pages, and IP addresses. Individual identities cannot be determined from these reports. The developers of this site use and disclose this information, including your IP address, to help us develop further content and features for the site. We use third parties to serve ads on our behalf across the internet. These parties may collect information about your visits to certain web pages on our site and may use technology such as cookies and Web beacons. Kultur Mercado does not disclose credit card account information provided by its members and customers. When members and customers choose to pay by credit card, we submit this information directly to a secure credit card processor.

Kultur Mercado makes available only organizational information that is already publicly available or knowingly provided to us, including organizational mailing address and website. 

Mailing lists of organizations are also made available to third parties upon request to Kultur Mercado. That information includes only an already publicly available mailing address.

We do not make email addresses available to third parties.

A Special Note About Children

Kultur Mercado does not knowingly gather any personally identifiable information from children under the age of 13.

Photographs & Videos
Kultur Mercado takes photographs and videos during public events, solicits photographs and videos from our members of their work, and occasionally selects quality photos or videos for distribution via this website, social media, or other means. Photos and videos are taken in public settings during public events. If you are included in a photograph or video and would prefer that it not be distributed, please contact us and let us know what photo or video and where you saw it. We will do our best to remove it from circulation.
